General Terms and Conditions of Sale

ARTICLE 1 - PURPOSE

The purpose of the present general terms of sale is to define, exclusively, by reason of the relations that they establish on the Internet network, the rights and obligations of the Parties arising from the online sale of the Products offered on the Site.

They regulate all the steps necessary for the placing of the order and ensure the follow-up of this order between the Parties.

These terms and conditions apply to the exclusion of all other documents.

 

ARTICLE 2 - PRODUCTS

2.1 Products

The Products offered for sale by Savanature are those listed on the Site, on the day the User consults the Site and within the limits of available stocks.

In case of unavailability of any of the Products, the client will be informed as soon as possible.

The photographs and texts illustrating the Products are not contractually binding.

2.2 Use of the products

Savanature shall not be liable for any damage caused by misuse of any of its Products or by failure to observe the precautions for use and health and safety conditions when using any of its Products or by failure of a retailer to provide such precautions.

2.3 Resale of Savanature products

The resale of Savanature products is allowed.

Repackaging of Savanature products for resale under another brand name is permitted.

 

ARTICLE 3 - PRICES

Prices are quoted in Euros, excluding VAT.

Any order placed on the Site and delivered outside the European Union and to the French Overseas Departments and Territories will be invoiced without VAT and may be subject to any taxes, customs duties and other related charges that are imposed when the package reaches its destination. These additional costs are the responsibility of the Customer.

The prices indicated on the Site are guaranteed on the day of the order within the limits of available stocks, and except for obvious typographical errors or omissions.

The prices indicated do not take into account the delivery costs which will be invoiced in addition or offered according to the amount of the order and the country of delivery, and will be specified to the User at the time of the final validation of his order.

These shipping costs do not include customs and other additional costs that may be required when entering certain countries, these costs remain the exclusive responsibility of the customer.

Savanature reserves the right, which the User accepts, to change its prices at any time.

 

ARTICLE 4 - ORDER REGISTRATION AND VALIDATION

4.1 Navigation within the Site

The User can find out about the different Products offered for sale by Savanature on its Website.

The User may browse freely through the various pages of the Site without being bound by an order.

4.2 Registering an order

If the User wishes to place an order, he/she will select the various Products in which he/she is interested, and will express his/her interest by clicking on the "add to basket" button.

At any time, the User may :

obtain a summary of the Products they have selected, by clicking on the basket.

continue or modify its selection of Products by clicking on "Continue shopping".

complete its selection of Products and order these Products by clicking on "Order".

In order to order the Products he has chosen, after having clicked on "Order", every User must identify himself, by entering his e-mail address and the password he will have previously chosen when creating his account, or, if it is his first order, by clicking on "Create my account". In the latter case, the User must accurately fill in the form provided, on which he/she must include the information necessary for his/her identification and in particular his/her surname, first name and postal address. In addition, the User must provide his/her e-mail address and a password of his/her choice, which will be personal and confidential and which he/she will need to identify him/herself later on the Site.

The User is informed and accepts that entering these two identifiers is proof of his/her identity and manifests his/her consent.

Once the User is identified, he/she must validate the delivery address (as specified in article 5 below) and an order form will appear on the screen, summarising: the nature, quantity and price of the Products selected by the User, as well as the total amount of the order, the delivery costs, the delivery time, the User's contact details and the delivery address of the Products.

Commercial offers

To benefit from a commercial offer that has been sent to him, the User must enter and validate his "promotional code", in the field provided, on the order summary page.

4.3 Final validation of the order and payment

After having read the status of the order, and once all the information requested has been completed by the User, a summary of this information and of the order will appear and the User must choose the method of payment with which he/she wishes to make his/her payment in order to definitively confirm his/her order.

Orders are payable in :

euros by French or international credit card, French or European bank transfer or by Paypal transfer.

It is specified that by making an immediate payment by credit card, the User will then be automatically transferred to the secure payment platform's electronic payment server. This platform is secured by S.S.L. (Secure Socket Layer) encryption in order to protect all data related to the means of payment, and at no time will the User's banking data transit on Savanature's computer system.

As soon as he validates his payment, the order is recorded. The User becomes a Customer. The order form will be recorded on Savanature's computer registers and will be considered as proof of the contractual relations between the Parties.

In accordance with article 6. below, the Customer has the right to withdraw and be reimbursed, during a period of fourteen (14) working days from the date of receipt of the Products by the Customer.

4.4 Order confirmation

A summary of the order will be displayed once the order has been validated.

This confirmation will include all the elements of the contract between the Parties.

This order summary will also be sent by e-mail to the Customer within minutes of the purchase.

The Customer will then have access to the "order tracking" by clicking on "my account" and identifying himself by his e-mail address and password.

4.5 Changing an order

The follow-up of past orders is accessible from the "My account" menu.

To modify an order, it is necessary to cancel the order, put it back in the basket and correct it as desired before validating it.

Modifying or cancelling an order is only possible when its status is "In progress".

An order placed in "in preparation" or "shipped" status can no longer be modified.

 

ARTICLE 5 - DELIVERY

5.1 Delivery times and methods

Your orders are processed as quickly as possible by the Customer Service and Shipping Department, open from Monday to Friday inclusive.

Orders are prepared as soon as payment is received. Payment by credit card guarantees rapid processing of your order.

Delivery time in mainland France

Shipments are made within 48 hours of receiving payment for your order, unless otherwise indicated on the "shopping cart" page.

After delivery by our Shipping Department, your order is delivered within 3 to 7 days by Colissimo.

These times are in working days, excluding postal delivery problems.

Delivery time to the rest of the world

Your order will be delivered by COLIPOSTE.

5.2 Delay / non-delivery

Loss of parcels in transit

Colissimo is a very reliable service. However, it is possible, as in any shipment, that there may be a delay in delivery or that the package gets lost. In the event of a delay in delivery of more than 7 days, the Customer must inform Savanature's customer service department, which will forward the information to the Post Office to initiate an investigation. This investigation may last up to 21 days from the date of its opening. If during this period, the parcel is found, it will be immediately sent back to the Customer's home (in most cases). If, on the other hand, the parcel is not found at the end of the 21-day investigation period, Colissimo considers the parcel as lost. In this case, Savanature will send a replacement package to the Customer, at its own expense. If the lost product(s) were no longer available at that time, Savanature will reimburse the Customer for the amount of these products.

Order cancellation

In case of delay in delivery of more than 10 days from the scheduled delivery date, the Customer may cancel the order by contacting Savanature Customer Service by email or telephone.

5.3 Anomalies

Any anomaly concerning the delivery (damage, open package, damaged package, broken products...) must be indicated on the delivery note in the form of "handwritten reserves", accompanied by the Customer's signature. The Customer must immediately report the anomaly to the Savanature Customer Service by so that a claim can be made to Coliposte.

Savanature will return the replacement product(s) to the Customer at its expense.

 

ARTICLE 6 - RETURN AND RIGHT OF WITHDRAWAL

Conditions of withdrawal

The Customer has a right of return of fourteen (14) days from the receipt of the totality of his order to retract without necessarily giving a reason.

In order to exercise the right of withdrawal, the customer must notify his decision to withdraw from his order by means of an unambiguous written statement, specifying his full name, e-mail address, order number and date:

Reimbursement

In the event of the Customer's withdrawal, Savanature shall refund any payments received from the Customer without undue delay and in any event no later than fourteen (14) days from the day Savanature is informed of the Customer's decision to withdraw.

In the event that the Customer withdraws from the entire order, Savanature will refund all payments received from the Customer for that order.

If the Customer withdraws from a part of the order, Savanature will refund the amount of the returned Products.

The refund will be made by the same means of payment that the Customer used for his/her order or by bank transfer.

Savanature may defer this refund until the Products have been received and verified.

Return of products

The Customer must return the Products no later than fourteen (14) days after having communicated his decision to withdraw.

Returned products must be unopened, complete and undamaged.

together with the following information on plain paper: first and last name, e-mail, address, order number and date.

The Customer shall bear the cost of returning the entire order or the Products.

 

ARTICLE 7 - QUALITY ASSURANCE

The Customer benefits from a quality guarantee on Savanature products.

If the defect is proven, Savanature undertakes to exchange or reimburse the defective or non-compliant products as well as the possible return costs within fourteen (14) days.

ARTICLE 8 - DATA PROCESSING AND LIBERTIES

The personal information collected in the context of distance selling is compulsory, as this information is necessary for the processing and delivery of orders and for the preparation of invoices. This information is strictly confidential and is not transmitted to third parties.

In accordance with article 34 of the law of 6 January 1978, the Customer has the right to access, modify, rectify and delete data concerning him/her.

ARTICLE 9 - DISPUTES

This contract is subject to French law. Savanature cannot be held responsible for damages of any kind, whether material or immaterial or physical, which could result from the misuse of the products sold.

In the event of difficulties in the application of this contract, the Customer has the possibility, before any legal action is taken, of seeking an amicable solution, in particular with the help of a professional association in the sector, a consumer association or any other advisor of his choice.

Complaints or disputes will always be received with attentive benevolence, good faith always being presumed in the person who takes the trouble to explain his situation. In the event of a dispute, the Client shall first contact the company to obtain an amicable solution.

In the absence of an amicable agreement between the Parties, the dispute shall be submitted to the French courts, unless otherwise provided by law.
